Terms of use (guests)

Last updated: October 2026.

1. Who we are

Water Tours Guide (“WTG”, “we”) operates a website and digital tools that connect users with independent operators of water experiences. WTG acts as a booking intermediary / marketplace unless expressly stated otherwise.

2. Acceptance

By using the site, Marina, forms, or linked channels, you agree to these terms and our privacy notice. If you disagree, do not use the service.

3. Nature of the service

  • Experiences are provided by third-party operators; WTG facilitates discovery, on-site availability, and booking flows.
  • A reservation request may require operator confirmation; capacity is not guaranteed until then.
  • Published prices, minimum durations, inclusions and exclusions prevail except for clear errors corrected transparently.

4. Payments & cancellations

Payment terms (deposit, full charge, currency) are those shown on the experience and on the payment link. Payments are processed by the payment provider (Stripe, PayPal or OXXO via Conekta, as available), which charges a processing fee.

WTG cancellation policy (applies to every booking paid through WTG):

  • You cancel 7 days or more before the trip: 100% refund of what you paid to WTG, minus the payment processor fee.
  • You cancel 3 to 7 days before: 50% refund of what you paid, minus the payment processor fee.
  • You cancel less than 3 days before: no refund.
  • Processor fee: the payment provider keeps its fee even when a booking is cancelled. When the customer decides to cancel, the customer bears that fee and it is deducted from any refund. A date change can be requested at any time, subject to the operator's availability.
  • Dangerous weather: for safety, trips do not depart in bad weather. The captain decides at least 2 hours before departure. You get a new date with the same operator and your payment stays as credit for 12 months; if no date works, we refund what you paid minus the processor fee.
  • If the operator cancels for its own reasons: full refund, including the processor fee.
  • If the trip departs in safe but not ideal conditions (or returns early by the captain's decision in safe weather), no discount applies.
  • Cancellations are requested from "My bookings" or through support with your WTG reference. WTG reviews the request and confirms the amount before cancelling or refunding.
  • If something went wrong on your trip (late departure, shorter than booked, or something included was missing), write to us with your reference within 72 hours. WTG reviews the case with the operator and, where it applies, refunds the corresponding part. That refund is covered by the operator or by WTG depending on who caused the problem; you are never charged for making a claim.
  • Refunds are processed as soon as possible. When they show up depends on the payment processor and your bank, so WTG cannot guarantee a timeframe.

Anything you pay directly to the operator (for example, a balance at the dock) follows what you agree with them.

5. User conduct

You agree to provide accurate information, use the site lawfully, and not compromise security. WTG may suspend abusive or fraudulent use.

6. Content & IP

All site content, photography, design, software, databases, and trademarks belong to WTG or its licensors and are protected by intellectual-property laws. Copying, reproducing, distributing, or exploiting them in any way without WTG's prior written authorization is prohibited. If you are interested in using any content or trademark, contact us first at info@premiereyachtscabo.com.

7. Limitation of liability

To the fullest extent permitted by applicable law, WTG is not liable for indirect, consequential, or lost-profit damages. WTG’s aggregate liability arising from marketplace use, except for wilful misconduct, gross negligence, or mandatory consumer-law provisions, is limited to fees paid to WTG attributable to the disputed booking in the prior twelve (12) months, or, if none, the minimum protection required by applicable consumer law. Inherent risks of water activities remain with the operator, local rules, and participants.

8. Third parties

Third-party links, WhatsApp, social networks, and payment gateways are governed by their own terms.

9. International users

WTG serves customers and operators in multiple countries (including Mexico, the United States, and other destinations where experiences are listed). You may book from abroad for local activities or while travelling. Operators remain responsible for compliance in their jurisdiction; WTG provides the marketplace and payments where enabled.

10. Governing law

Unless mandatory consumer rules in your country require otherwise, these terms are governed by the laws of Mexico, with venue in Cabo San Lucas, Baja California Sur, Mexico, without prejudice to alternative dispute resolution where required.
