Last updated: November 2026. The Spanish version prevails.
In short
We use your data only to run your account and bookings, take payments, support you, issue invoices and comply with the law.
We share it only with those who make that service possible. We do not sell it.
Promotions only if you opt in; unsubscribe anytime.
From your account you can download your data, correct it or ask us to delete it. Also by email to info@premiereyachtscabo.com.
We do not use advertising trackers or sell profiles.
1. Who is responsible for your data
Water Tours Guide (“WTG”, “we”), located in Cabo San Lucas, Baja California Sur, México, operating dominio-pendiente.invalid. Our privacy team handles everything about your data at info@premiereyachtscabo.com.
2. Data we use
We do not ask for sensitive data (health, origin, beliefs, etc.). Please do not write it in messages.
Customers: name, email, phone and WhatsApp if you give them, language, city and country; booking details (experience, date, time, guest count, trip requests), messages with WTG, reviews and cancellation or refund requests. If you ask for an invoice: tax ID (RFC), legal name, tax regime, postal code, CFDI use and billing email.
Guests who sign a trip waiver: name and signing date.
Payments: your card details go straight to the payment processor. WTG only receives the transaction ID, amount and status.
Operators and their staff: name and contact, company details, compliance documents (permits, insurance, IDs), bank details for settlements and tax details for withholdings.
Sellers: name and contact, and bank and tax details to pay their commissions.
Marina (site assistant): what you write to it. Marina runs on our own server; those conversations are not sent to other AI companies.
Technical: IP address, browser and security logs (logins, account changes), and the cookies in our cookie policy.
3. Why we use it
3.1 Necessary purposes
Needed to provide the service you asked for, so they do not require your consent:
Create and run your account.
Handle your requests and bookings and coordinate them with the trip operator.
Charge, refund and pay operators and sellers what they are owed.
Send booking notices: confirmations, pending payments, trip reminders and a review invitation after the trip.
If you give us your WhatsApp and accept that contact, a WTG team member may message you there, by hand, only about your bookings. We send no automated messages or advertising over WhatsApp.
Support you and resolve claims.
Issue invoices and meet tax and legal obligations.
Verify operators, protect accounts and prevent fraud.
3.2 Optional purpose
Promotions and the frequent customer program by email, only if you tick the box; your account and bookings work the same if you do not. Withdraw it anytime in My profile and security → Promotions, when you leave a review, with the unsubscribe link or by writing to info@premiereyachtscabo.com; you leave the program right away. If you opted in, we may take your trips and the reviews you post into account to offer you exclusive discounts or perks for frequent or featured customers; this never changes the price or terms of any booking. Inside WTG only management chooses who gets those perks; the marketing team only sees your short name if you are in a group and never sees your email or phone: the platform sends the messages. We count which links in those emails are opened to learn what interests you; we do not use pixels to know whether you opened an email. If we ever want to use your data for something else, we will ask first.
4. Who we share it with
Your trip operator, only what is needed to run it: your short name (first name and last initial), date, time, guest count and trip requests. They do not see your email or phone: messages go through WTG.
The WTG certified seller assigned to you, if any: sees your contact details to follow up.
Providers working on WTG’s behalf: payment processors (Stripe and Conekta), server hosting and email (Hostinger), site network and security (Cloudflare), and Meta (WhatsApp) or Telegram only if you accept that contact. Some are outside Mexico; they use the data only to provide their service to us.
Authorities (for example, the Mexican tax authority) when a law or order requires it.
These transfers do not need your consent because they are needed for the contract you asked for, for our relationship with you, or by law. We make no other transfers; if we ever wanted to, we would ask you first. We do not sell your data.
5. How to limit the use of your data
Turn off promotions in My profile and security → Promotions or with the unsubscribe link.
Turn off WhatsApp or Telegram contact in the same place, or just ask us.
Delete your saved tax details when you no longer need them.
Ask us to stop a specific use (right to object, section 6).
6. Your rights
You can access, correct and delete your data, object to a specific use and withdraw your consent, free of charge.
From your account:My profile and security → My data (customers) or Security and my data in your panel (operators and sellers). Download a copy instantly and file any other request; since you are logged in, no extra ID is needed.
By email to info@premiereyachtscabo.com, subject “Privacy rights”, with your name and a way to reply, an ID (or your representative’s and proof of representation), the right you are exercising and on which data, and anything that helps us find it (for example, your booking reference).
Timeframes: we answer within 20 business days of receiving your request and, if it applies, carry it out within the following 15 business days. Each period may be extended once by the same length when justified; we will tell you why.
Limits: even if you ask for deletion, we keep blocked what the law requires (paid bookings, payments, invoices and tax data) or what is needed while you have an upcoming trip; we delete your contact details and everything else. If we deny a request we always tell you why. If you disagree, you may file a complaint with Mexico’s data protection authority (Secretaría Anticorrupción y Buen Gobierno) within 15 business days, or with your local authority if another law applies to you.
7. How long we keep it
Requests and quotes that never became a booking: contact details anonymized after 12 months without activity.
Log of emails we sent you: content deleted and address masked after 6 months.
Marina conversations: deleted after 90 days without activity.
Record of promotional emails (sent and clicks): your address is deleted after 24 months; only counts remain.
Bookings, payments, refunds and tax data: for the periods required by tax and commercial law, then deleted.
Your account: while you use it; on a deletion request, section 6 applies.
8. How we protect it
Encrypted connection across the site, team access limited by role, two-step verification for every account, backups and activity logs. If a security breach significantly affects your rights, we will tell you right away what happened and what you can do.
9. Minors
Accounts and bookings are made by adults. If a minor travels, an adult books and is responsible. If you find a minor’s data registered without a responsible adult, write to info@premiereyachtscabo.com.
10. Changes
The current version is posted here with its date. If a change affects the purposes, the data we use or who we share it with, we will also email you before it applies and, where the law requires, ask for your consent again.
